Data Breach Protections Pass

The Senate passed bipartisan legislation seeking to expand protections for consumers when there is a data breach.

Key Points:

    • Senate Bills 360 – 364 were introduced by Senators Rosemary Bayer (D-West Bloomfield), Stephanie Chang (D-Detroit), Sue Shink (D-Northfield Twp.), Mary Cavanagh (D-Redford Twp.), and Ed McBroom (R-Waucedah Twp.).
    • The bills would enforce stronger safeguards for companies that collect, own, or access personal information.
    • It requires a company to investigate and notify consumers and the Attorney General’s office if they believe a security breach has or may have occurred, if the number of those impacted exceeds 100.
    • The legislation empowers the Michigan Attorney General’s office to investigate breaches.
    • Thirty-seven states currently require that entities notify the Attorney General when data breaches occur.

Next Steps:

    • The bills were referred to the House Government Operations Committee for consideration.
