The legality of the legislature’s use of adopt and amend on a ballot proposal increasing the minimum wage will go before the Michigan Supreme Court next week during December’s oral arguments.

Key Points:

    • In 2018, two citizens’ initiatives raising the state’s minimum wage and earned sick time laws collected enough voter signatures to place the issues on the general election ballot.
    • Before the election, the legislature chose to approve the measures and shortly thereafter passed legislation greatly reducing the impact of the initiatives. Governor Snyder signed the changes into law.
    • The disagreement over the constitutionality of the adopt and amend strategy has been ongoing and several courts have ruled on the issue.

The Supreme Court will hear a total of 12 cases during oral arguments on December 6 and 7, including this case on December 7 at 9:30 a.m.
