Secretary of State Asks for Legal Opinion

Secretary of State Jocelyn Benson requested an Attorney General Opinion regarding the six-day grace period allowed for absent voter ballots for overseas voters.

Key Points:

    • Under Proposal 2022-2, those serving in the military or living overseas will have their ballot counted if it is postmarked on or before election day and received within six days after the election.
    • That is causing an issue this year because the sixth day falls on Veterans Day, a state holiday, thus no mail would be delivered.
    • The Secretary is asking for clarification on the law for when the sixth day falls on a weekend or legal holiday.
    • In her request, Secretary Benson believes the deadlines should be extended by one secular day and is asking for Attorney General Dana Nessel’s legal opinion on the matter.
