Legislation Repealing Environmental Rules Committee Passes

A three-bill package repealing the Environmental Rules Review Committee (ERCC) was passed by the legislature this week. The committee oversees the rulemaking of the Department of Environment, Great Lakes, and Energy.

Key Points:

    • The ERCC was created by Public Act 267 of 2018.
    • Membership includes four ex-officio department heads and twelve members appointed by the governor, representing relevant industries and organizations.
    • The legislation repeals the section in law that created the committee.
    • Those who support the legislation state the rule-making process will be quicker and more efficient without the committee.

Next Steps:

    • The bills will be sent to Governor Whitmer for her consideration.
