Minimum Wage Legal Battle Continues

In the latest in the ongoing legal battle over the legislature’s use of adopt and amend as it pertains to increasing the state’s minimum wage and paid sick leave laws, the Michigan Supreme Court will hear oral arguments on the case.

Key Points:

    • In 2018, two citizens’ initiatives raising the state’s minimum wage and earned sick time laws collected enough voter signatures to place the issues on the general election ballot.
    • Prior to the election, the legislature chose to approve the measures and shortly thereafter passed legislation greatly reducing the impact of the initiatives. Governor Snyder signed the changes into law.
    • The disagreement over the constitutionality of the adopt and amend strategy has been ongoing and several courts have ruled on the issue.

Next steps:

    • The Michigan Supreme Court will hear oral arguments on the adopt and amend strategy and issue a ruling. The date of oral arguments has not yet been set.
