Governor Signs Red Flag Laws

A person can seek a court order to temporarily confiscate the firearms of a person they fear may harm themselves or others under legislation signed into law by Governor Gretchen Whitmer.

Key Points:

    • A police officer, health care professional, or a family member could petition the court for an Extreme Risk Protection Order.
    • If the court agrees, the individual would be prohibited from possessing or purchasing a firearm.
    • The person subject to the order would be disqualified from a pistol license or concealed pistol license.

Impact:

This is the latest in a series of proposals the Democratic Caucuses have been working on to reform gun laws in Michigan. The caucuses continue to review other actions that could be taken which may help reduce violence.
